CCI NEWSFLASH –
EXPLANATORY NOTE
CCI wishes to draw your attention to the notice (GN 971 of 9 October 2009) published by the Minister of Water and Environmental Affairs on 9 October 2009 which amends listed activity 1(i) of GNR 387 of 21 April 2006.
The purpose of the above-mentioned amendment is to specifically
exclude
the
extraction or processing of gas from landfill sites
from the list of activities identified in terms of section 24(2)(a) and (d) of the National Environmental Management Act, 107 of 1998 (NEMA) and for which an environmental authorisation is required prior to the commencement thereof.
The
extraction, recovery or flaring of landfill gas
is now provided for as a listed waste management activity in the National Environmental Management Waste Act, 59 of 2008 (NEMWA) and accordingly, the aforesaid activity must be authorised by way of a waste management licence in terms of the NEMWA and not an environmental authorisation in terms of the NEMA.
