The Minister of Water and Environmental Affairs determined 11 September 2009 as the date on which the National Environment Laws Amendment Act, 44 of 2008 (NELAA) came into operation. The NELAA amended the APPA by:
- Regarding this Act as a specific environmental management Act until section 60 of the National Environmental Management: Air Quality Act, 2004, takes effect.

The Minister of Water and Environmental Affairs determined 18 September 2009 as the date on which the National Environmental Laws Amendment Act, 14 of 2009 (AA) came into operation, except for sections 39 and 44. The AA amended the APPA by:
- Adjusting the penalties provided for in the APPA.

Judgment was handed down in the Supreme Court of Appeal (SCA) on 11 September 2009 in the Nature's Choice Properties (Alrode) (Pty) Ltd vs the Ekurhuleni Metropolitan Municipality matter. The SCA held that the Municipality misconstrued its discretion in terms of the Smoke Control Regulations promulgated in terms of section 18 of the Atmospheric Pollution Prevention Act, 45 of 1965. The SCA upheld the appeal and set aside the interdict and order to remove the boiler installed by Nature's Choice which was initially granted by the Court a quo in favour of the Municipality.

The Minister of Environmental Affairs and Tourism gave notice that the Waste Tyre Regulations, as published on 13 February 2009 shall come into operation on 30 June 2009. These regulations pertain to the management of waste tyres. According to these regulations, no person may manage waste tyres in a manner which does not comply with these regulations; recycle, recover or dispose of a waste tyre, or knowingly or negligently cause or permit a waste tyre to be recycled, recovered or disposed of, at any facility or on any site, unless the recycling, recovery or disposal of that waste tyre is authorised by law; recover or dispose of a waste tyre in a manner that is likely to cause pollution of the environment or harm to health and well-being; or dispose of a waste tyre at a waste disposal facility two years from the date of commencement of these regulations unless such a waste tyre has been cut into quarters. Further, duties are conferred upon waste tyre stockpile owners, tyre producers, tyre processors or tyre dealers. See Government Notice No. 520 of Government Gazette No. of 32219 of 8 May 2009.

In the recent High Court case of Tergniet And Toekoms Action Group And Others V Outeniqua Kreosootpale (Pty) Ltd (case number 10083/2008) the matter of emission of pollutants into the atmosphere in terms of the Atmospheric Pollution Prevention Act No 45 of 1965 (hereafter 'APPA') was raised yet again.
