ENVIRONMENTAL LEGISLATION
National Water Act, 36 of 1998
The Acting Director-General of the Department of Water Affairs published a notice restricting the taking of raw water for domestic and industrial purposes from natural resources as well as the taking of groundwater from private boreholes for the irrigation of gardens in the Municipalities of Mossel Bay, George, Knysna and Bitou in the Western Cape from 1 January 2010 until further notice. National Environmental Management: Biodiversity Act, 10 of 2004
The Minister of Water and Environmental Affairs published non-confidential information from a Bio-prospecting Benefit Sharing Agreement received for approval in terms of section 83 of the National Environmental Management: Biodiversity Act for public comment in the Schedule to the Notice. Any representations or objections to the proposed Benefit Sharing Agreement were to be lodged within 30 days from the date of publication of the notice (i.e. on or before 2 August 2010). National Environmental Management Act, 107 of 1998
The Minister of Water and Environmental Affairs published the Model Air Quality Management By-law in the Schedule to the Notice for easy adoption and adaptation by municipalities. See Government Notice No. 579 of Government Gazette No. 33342 of 2 July 2010.
National Energy Regulator Act, 40 of 2004
The National Energy Regulator of South Africa published the preliminary ROMPCO pipeline transportation tariff for the period October 2008 to April 2010. The preliminary tariff is available to members of the public for comments on the NERSA website at www.nersa.org.za. Any comments on the preliminary tariff by members of the public were to be lodged by 23 July 2010. See Government Notice No. 106 of Government Gazette No. 33359 of 9 July 2010.
National Environmental Management: Waste Act, 59 of 2008
The Minister of Water and Environmental Affairs intends to make the National Waste Information Regulations as set out in the schedule to the notice. Interested and affected parties are invited to submit written comments as part of the second public consultation period within 30 days of the publication of the notice (i.e. on or before 23 August 2010). Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 36 of 1947
The Minister of Agriculture, Forestry and Fisheries intends to introduce the Proposed Fertilizers and Feeds Bill in the National Assembly. Interested persons are invited to a workshop on the Proposed Bill to be held on 12 August 2010. See Government Notice No. 745 of Government Gazette No. 33399 of 30 July 2010.
HEALTH AND SAFETY LEGISLATION
Medicines and Related Substances Act, 101 of 1965
The Minister of Health intends to amend the Regulations Relating to a Transparent Pricing System for Medicines and Scheduled Substances as set out in the schedule to the notice. The proposed amendment relate to the 2010 recommendation of the Pricing Committee on the Draft 2010 dispensing fee to be charged by the persons licensed in terms of section 22C(1)(a) of the Medicines and Related Substances Act. Interested persons were requested to submit comments on the proposed amendments within 4 weeks of the publication of the notice (i.e. on or before 2 August 2010). The Minister of Health intends to make the Regulations relating to a Transparent Pricing System for Medicines and Scheduled Substances in respect of the dispensing fee for pharmacists as set out in the schedule to the notice. Interested parties are invited to submit any substantiated comments or representations on the proposed regulations, in writing, within one month from the date of publication of the notice (i.e. on or before 23 August 2010). Health Professions Act, 56 of 1974
The Health Professions Council of South Africa intends to amend the Rules relating to the Registration by Radiographers of Additional Qualifications as reflected in the Schedule to the Notice. Interested parties are invited to submit any substantiated comments or representations in writing on the proposed amendment, within three months from the date of publication of the notice (i.e. on or before 8 October 2010). PROVINCIAL LEGISLATION
National Environmental Management: Protected Areas Act, 57 of 2003
The Provincial Minister of Local Government, Environmental Affairs and Development Planning in the Western Cape intends declaring the Knersvlakte Nature Reserve on the properties as indicated in the schedule to the notice. Members of the public are invited to submit representations on or objections to the proposed declaration, in writing, within 60 days from the date of publication of the notice (i.e. on or before 31 August 2010). National Environmental Management Act, 107 of 1998
The Gauteng Province prepared its 2nd edition Environmental Implementation Plan in line with the provisions of Chapter 3 of the NEMA. The Environmental Implementation Plan identifies the policies, plans and programmes within the Provincial Departments in Gauteng, three national departments with provincial offices in Gauteng, as well as the local authorities within the province, that could have significant impacts on the environment. It indicates measures that the affected departments have put into place to improve their environmental performance, as well as the co-operative governance mechanisms to ensure integrated environmental management.
